The petitioner seeks bail in anticipation of his arrest in connection with Roh P.S. Case No. 130 of 2020 instituted for the offence under Section 30 (a) of Bihar Prohibition & Excise (Amendment) Act, 2016.

According to the First Information Report, 123.750 litres of liquor was recovered from behind the house of one Gango Choudhary and the name of the petitioner and others have been disclosed by Gango

Patna High Court CR. MISC. No.39606 of 2020(2) dt.01-06-2021 2/3 Choudhary and Gulabi Devi, who were arrested after the raid.

Learned counsel for the petitioner has submitted that the accusation against the petitioner is based solely on the confession of arrested accused persons and that out of the same occurrence, two cases have been lodged ; one being the present case and the other being Roh P.S. Case No. 115 of 2019 about which reference has been made in paragraph -3 of the bail petition. In the aforesaid case, the petitioner has been granted bail.

Considering the afore-stated facts, the petitioner, above named, is directed to be released on bail in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order on furnishing bail bonds of Rs. 10,000/- (Rs. Ten Thousand) each with two sureties of like amount to the satisfaction of learned Additional Sessions Judge -II-
