The petitioner apprehends his arrest in connection with Telhara P.S. Case No. 62 of 2017, registered under Section 414 of the Indian Penal Code.

The accusation is that, in course of checking of the vehicle, one Avinash Kuamr was apprehended with motorcycle. On query, Avinash Kuamr did not produce any papers regarding the motorcycle bearing no. BR01 AT 7241 and also disclosed that the said motorcycle was purchased from his cousin brother, Vinay Kumar (petitioner) and one Pappu Kumar.

Learned counsel for the petitioner submits that the

Patna High Court Cr.Misc. No.51824 of 2017 (2) dt.08-11-2017 name of the petitioner has been disclosed by co-accused, Avinash Kumar, who was apprehended with stolen motorcycle, and he has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Hilsa at Nalanda, in connection with Telhara P.S. Case No. 62 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
