JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-12-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in registered for the offence punishable under Section 414 of the Indian Penal Code. As per prosecution case, some mobile phones and other articles were recovered from co-accused. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Petitioner has been made accused in the present case only on the basis of confessional statement of co-accused who was apprehended on the spot with incriminating articles. Learned counsel for the State opposes the prayer for bail application submitting that petitioner has got one criminal antecedent of similar nature.
Considering the fact that petitioner has got one
Patna High Court CR. MISC. No.43522 of 2022(2) dt.05-12-2022 2/2 criminal antecedent of similar nature, prayer for bail of the petitioner is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
