14-10-2015 Heard Sri Krishna Deo Raj, learned counsel for petitioners and Mr. M. Rab, learned Addl. Public Prosecutor. Four petitioners, apprehending their arrest in Roh P.S. Case No. 58 of 2015 registered for the offence under Section 307 & other allied sections of the Indian Penal Code, have prayed for grant of anticipatory bail.
It was submitted by learned counsel for petitioners that since informant side had committed offences against the petitioners' side and petitioners & brother of petitioner no. 1 had approached for lodging a case, the present F.I.R. was lodged by the informant to create a defence. He submits that moreover in the
Patna High Court Cr.Misc. No.46146 of 2015 (2) dt.14-10-2015 2/2 F.I.R., there is no specific accusation against the petitioners and he has referred to Annexure - 3 to the petition i.e. F.I.R. of SC/ST P.S. Case No. 50 of 2015 registered under Sections 447, 147, 148, 149, 341, 323, 504/506 of the Indian Penal Code and Section 3(i)(x) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989, in which, the brother of petitioner no. 1 is informant.
In view of the facts & circumstances, particularly; the nature of accusation in the F.I.R., let all the aforesaid petitioners, namely; Agam Ram, Himalay Ram, Suresh Ram and Bado Ram @ Boda Ram in the event of their arrest or surrender within a period of eight weeks from today be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Sujeet Kumar, Judicial Magistrate Ist Class, Nawada in connection with Roh P.S. Case No. 58 of 2015, subject to condition as laid down under Section 438(2) of the Cr.P.C.
