JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-11-2018 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Naubatpur P.S.Case No. 274 of 2017, registered for the offence under Sections 147, 148, 149, 323, 324, 325, 326, 307, 302, 504, 506 of the Indian Penal Code and 27 of the Arms Act. Allegation against the petitioner as per F.I.R. is of assault by sword to the son of the informant on account of which, the son of the informant died.

Submission of the learned counsel for the petitioner is that there is no overt act has been attributed against the petitioner and the petitioner and informant are agnates and other accused person has been granted bail by a Co-ordinate Bench of this Court

Patna High Court Cr.Misc. No.60830 of 2018 (3) dt.01-11-2018 2/2 vide order dated 08.05.2018 passed in Cr. Misc. No. 15491 of 2018 and he is in custody since 09.07.2018.

Heard learned A.P.P. also who opposed the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner.

With the aforesaid observation, the instant petition is accordingly dismissed.
