ANJANA MISHRA ORAL ORDER 19-01-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
The petitioners are apprehending their arrest in connection with Azamnagar P.S. Case No. 193 of 2015 registered for offences punishable under Sections 147, 149, 341, 323, 307, 380, 504, 456, 435 of the Indian Penal Code and Section 3/4 of Witch Craft Act.
Learned counsel for the petitioners submits that the petitioners have been named in the F.I.R out of the village politics and the assault on the informant and her daughter in law was not engineered on account of some allegations rather the same came to be engineered on account of the land dispute. It is submitted that
Patna High Court Cr.Misc. No.50461 of 2015 (3) dt.19-01-2016 2/2 though the petitioners have been named in the F.I.R., the said allegations are wholly general and omnibus in nature and no specific overt act has been attributed to them. Considering the nature of allegations made against the present petitioners and also that the petitioners no. 3, 4 and 7 have no criminal antecedent, whereas petitioners no. 1,2,5,6,8 and 9, have been implicated by son of the informant in one another case being Azamnagar (Salmari) P.S. Case No. 145 of 2014, let the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (Rs. Ten Thousand) each with two sureties of the like amount each to the satisfaction of D.K. Rai, J.M. Ist Class, Katihar in connection with Azamnagar P.S. Case No. 193 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
