====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ---------------- 14-10-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Malsalami P.S. Case No.113 of 2015 registered under Sections 341, 323, 324, 379 and 504/34 of the Indian Penal Code. The allegation of the informant is that on the occasion of marriage, some boys were quarreling in drunken state and when the informant made protest, the boys caused injury to him with iron rod and electric bulb on his nose, eyes and face. At that time, the boys also snatched the gold chain and ring of the informant. The informant claim to have identified the petitioner as one of the boys.

Patna High Court Cr.Misc. No.43428 of 2015 (2) dt.14-10-2015 2/2 Learned counsel appearing on behalf of the petitioner submits that petitioner is student of B.A. Part-I and has falsely been implicated in this case by the informant on mere suspicion. Later on, the informant coming to know the real fact, has filed a compromise petition in the court of the Judicial Magistrate, First Class, Patna City, Patna, on 28.09.2015.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount to the satisfaction of Sri R.S. Pandey, Judicial Magistrate, First Class, Patna City, Patna, in connection with Malsalami P.S. Case No.113 of 2015, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
