The petitioner seeks bail in Benipatti P. S. Case No. 27 of 2018 instituted for the offence under Section 376 of the Indian Penal Code and Section 4/6 of the POCSO Act. It is alleged in the written report that 8 years old daughter of the informant was raped by this petitioner. Case diary has been received, wherein, postmortem report of the victim girl is available. The doctor has mentioned in the postmortem report that on clinical/pathological examination injury over private part may be due to sexual offence. The doctor has assessed the age of victim girl between 7 to 8 years.Therefore, this Court is not inclined to grant bail to the petitioner at this stage. The prayer for bail of the petitioner
Patna High Court Cr.Misc. No.59330 of 2018(3) dt.01-11-2018 2/2 stands rejected.
Trial Court is directed to expedite the trial and make all efforts to conclude the same as early as possible preferably within a period of nine months from the date of receipt of copy of this order.
