2. The petitioner has prayed for quashing the order dated 20.12.2018 and 04.01.2023 passed in Complaint Case No. 1190 of 2014 by which the learned Chief Judicial Magistrate, Arwal has issued proceeding under Sections 82 and 83 of the Code of Criminal Procedure.
3. The contention of the petitioner is that the petitioner is a retired Branch Manager of the Punjab National Bank and he had no knowledge about the criminal case and therefore he could not appear before the Court below. He further submits that he will appear before the Court below.
4. Considering the submission of the petitioner and
Patna High Court CR. MISC. No.48978 of 2024(2) dt.20-08-2024 2/2 also considering the fact that the petitioner is a retired Bank employee and he has no intention to evade the process of arrest, this application is allowed.
5. Accordingly, the dated 20.12.2018 and 04.01.2023 passed in Complaint Case No. 1190 of 2014 by which the proceeding under Sections 82 and 83 of the Code of Criminal Procedure which has been issued against the petitioner are hereby quashed.
