JUSTICE SUDHIR SINGH ORAL ORDER 23-11-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 3, 9(i), 6(ii) and 29 Rules 9, 9(8) P.C. & P.N.D.T. Act.
Allegation against petitioner is that during inspection no doctors including some irregularities were found at his Ultrasound Centre.
It is submitted on behalf of the petitioner that petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses against petitioner. Petitioner has been made accused due to mistake of fact. The Ultrasound Centre of petitioner used to run between 10 A.M. to 3 P.M. Inspection was made at 3-30 P.M. Hence, the consultant doctor was not present at the Centre. The present case has been instituted for oblique reason.
On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his/her arrest or surrender
Patna High Court Cr.Misc. No.50209 of 2016 (2) dt.23-11-2016 2/2 in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Complaint Case no. C272 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) sudip/- U T
