The petitioner seeks pre-arrest bail in connection with Antichak P. S. Case No. 25 of 2015 registered under Sections 147, 148, 149, 341, 323, 325, 307, 379 & 506 of the Indian Penal Code. It is contended that there is a case and counter case. Members of both sides sustained simple and superficial injuries. It is further contended that six other co-accused named in the FIR along with the petitioner have already been granted anticipatory bail by a Bench of this Court vide order dated 13.10.2015 passed in Cr. Misc. No. 43755 of 2015.
Learned counsel for the State has opposed the
Patna High Court Cr.Misc. No.49273 of 2015 (2) dt.02-11-2015 2/2 application of the petitioner filed under Section 438 of the Code of Criminal Procedure.
Regard being had to the fact that similarly circumstanced six co-accused have already been granted anticipatory bail by a Bench of this Court vide order dated 13.10.2015 passed in Cr. Misc. No. 43755 of 2015, in the event of arrest or surrender before the court below within four weeks from today, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bhagalpur in Antichak P. S. Case No. 25 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J.) Kanchan/- U T
