This is an application for bail in connection with Gurua (Sherghati) P.S.Case No. 170 of 2016 registered for the offences punishable under Sections 376, 511, 307 and 302 of the Indian Penal Code.

Allegation against the petitioner is of committing rape and causing her death.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and he is in custody since 22.12.2016.

Heard learned APP also, who has opposed prayer for bail stating that there is specific allegation against the petitioner. Having heard both sides and in view of serious nature of

Patna High Court Cr.Misc. No.52540 of 2017 (2) dt.13-11-2017 2/2 allegation, I am not inclined to grant bail to the petitioner. However, learned trial court is directed to conclude the trial expeditiously.
