2. The petitioner has prayed for bail in connection with Complaint Case No.683 of 2020 registered for the offence punishable under Sections 376, 323, 406 of the Indian Penal Code.

3. The case of the prosecution based on complaint petition is that the petitioner has committed rape with the complainant for last three years on the false promise of marriage.

4. Learned counsel appearing on behalf of the petitioner has submitted that from perusal of the complain

No.41911 of 2026(2) dt.29-06-2026 2/3 petition it is clear that it is alleged that the petitioner has committed rape with the victim on false promise of marriage for last three years but there is no explanation as to why the complain was not filed earlier. Learned counsel for the petitioner has submitted that in solemn information the victim herself has stated that on 09.06.2025 the villagers have seen the petitioner with the complainant in compromising position. It is further alleged that on same day, the petitioner called her to bamboo clamps where the petitioner committed rape with her. It has further been submitted that it is a case of relationship between two adults and breakup thereafter. The allegation of rape is alleged as she was found in compromising position with the petitioner. It has been submitted that the petitioner is having no criminal antecedent and he is in judicial custody since 25.03.2026.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties
