JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 19-12-2016 This is an application, under Section 407 of the Code of Criminal Procedure, seeking transfer of proceedings arising out of Kharagpur P.S. Case No. 258 of 2013 (G.R. Case No. 2327/2013), registered for the offence punishable under Section 414 of the Indian Penal Code, from the Court of learned learned Sub-Divisional Magistrate, Munger, to any Court of equivalent jurisdiction at Supaul.

Patna High Court Cr.Misc. No.48782 of 2016 (2) dt.19-12-2016 2/2 On perusal of the application, I notice that no case of transfer of criminal case is at all made out. The only plea, which has been taken for such transfer, is that another First Information Report, bearing Baluwa Bazar P.S. Case No. 30 of 2013, under Section 379 of the Indian Penal Code, has been registered by the brother of the petitioner. The said Baluwa Bazar police station is under Supaul district. It cannot be a ground for transfer of the case. I do not find any merit in this application.

This application is, accordingly, dismissed.
