JUSTICE ARUN KUMAR ORAL ORDER 13-12-2017 Heard learned Counsel for the petitioners and the State. Petitioners, already in custody, seeks bail in POCSO Case No. 22 of 2017 Bakhtiyarpur PS Case No. 51 of 2017 registered under Sections 494, 498, 366A, 376, 120B of the IPC and Section 4 of the POSCO Act.
Learned Counsel for the petitioners submits that the petitioners are married sister of Brahamdeo Sharma, the principal accused, and her husband and only role as stated by the girl is that both came to the station to see off along with Brahamdeo Sharma at the station. The elder brother of Brahamdeo Sharma, Kapil Sharma and Runa Devi, his wife, have also been granted bail by a coordinate Bench of this Court and the case of the petitioners stands on similar footing.
The specific allegation of kidnapping and committing rape is against Brahamdeo Sharma and there is no allegation of sexual abuse by the petitioner no. 1.
Having considered the said facts and circumstances, the petitioners, namely, Pappu Sharma and Samful Devi @ Semful Devi
Patna High Court Cr.Misc. No.57902 of 2017 (2) dt.13-12-2017 are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of lst Additional Sessions Judge -cum- Special Judge, Saharsa in connection with POCSO Case No. 22 of 2017, Bakhtiarpur PS Case No. 51 of 2017.
