JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-05-2023 The present writ petition has been filed seeking the following reliefs:- "1(I). For issuance of a direction, writ in the nature of mandamus any other appropriate writ commanding the respondent no. 4 / company to complete construction of house at the earliest, so that delivery of possession of construction of Simplex/house may be given to the petitioner complete in all respect as per Agreement dated 16/11/2012 which was made by petitioner and Company/Promoter.

(I1). For Issuance of a direction Writ in the nature of mandamus any other appropriate Writ

Patna High Court CWJC No.11357 of 2022(2) dt.01-05-2023 2/2 if the respondent No. 4/Company fail to complete construction of House at the earliest then he refund of entire payment of Rs. 1,80,000 + 5,60,000 = 7,40,000/- including Stamp/Registration Fee along with a compound interest @18% per annum.

For issuance of a direction Writ in the nature of mandamus any other appropriate Writ the Hon'ble Court may direct the respondent No. 4/Company to pay compensation to the petitioner for facing miseries, mental agonies, harassment she has suffered due to inordinate delay in the completion of the House."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law. Liberty, so sought, is granted.
