2. The petitioner seeks regular bail in the present case registered for the offence under Sections 30(a), 30(c), 30(d) and 36 of the Bihar Prohibition and Excise (Amendment) Act, 2022.
3. As per the prosecution case, 31.140 liters of country made liquor has been recovered from the house of the co-accused.
4. Learned counsel for the petitioner submits that the name of the petitioner has come on the confessional statement of the co-accused namely Deepak Kumar. Petitioner is in custody since 22.03.2024.
5. Learned A.P.P. has vehemently opposed the
Patna High Court CR. MISC. No.45679 of 2024(2) dt.03-07-2024 2/2 prayer for bail.
6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.
7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise Court No. 01/ Rohtas at Sasaram/concerned Court below in connection with Bikramganj P.S. Case No. 153 of 2024 subject to condition that:- 7(i). The petitioner will mark his attendance at the Bikramganj Police Station on the first and third Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
