JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-01-2019 Earlier prayer for bail of the petitioner has been dismissed twice vide order dated 09.08.2017 and 25.04.2018 passed in Cr. Misc. No. 34022 of 2017 and Cr. Misc. No. 18012 of 2018 respectively and the petitioner happens to be husband of the deceased and allegation against him is of causing death of the deceased.

Submission of learned counsel for the petitioner is that petitioner has been in judicial custody since 02.05.2017 and and still two witnesses has to be examined and there is no likelihood of conclusion of trial in near future. Heard learned A.P.P. and perused the report of learned Trial Court, from which, it appears that five witnesses have been examined and summons have been issued to the doctor for his examination.

Patna High Court Cr.Misc. No.60415 of 2018(4) dt.09-01-2019 2/2 Considering the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the petitioner on bail. This application is, accordingly, dismissed. Learned Trial Court is directed to conduct the trial on day to day basis and try to conclude the same as early as possible.

At the same time, Superintendent of Police, Khagaria is directed to ensure the production of doctor and other witnesses in the trial court on the date fixed so that the trial be concluded expeditiously.
