The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 153A of the Indian Penal Codeand Section 67 of the I.T. Act. As per prosecution case, the allegation against the petitioner is that he after taking picture of a mosque, edited it, into a temple and wrote Jai Shree Ram and other anti-social elements on the same and made it viral. It is further alleged that he was apprehended by the police officials and from his possession one vivo company mobile was recovered. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has

Patna High Court CR. MISC. No.46463 of 2023(2) dt.04-08-2023 2/2 falsely been implicated in this case. He has got no criminal antecedent. Except video viral nothing wrong doing against law and order has been committed by the petitioner. It is further submitted that the petitioner is languishing in judicial custody since 01.04.2023.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Dighwara P.S. Case No. 108 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-IInd Saran at Chapra. If the petitioner repeats offence of similar nature after enlargement on bail, his bail bonds will be cancelled by the learned Court below.
