2. The petitioner apprehends his arrest in a case registered for the offence under Sections 341, 323, 354, 452, 353, 427, 504, 506, 34, 354(B), 307 of the Indian Penal Code and Section 37(b)(b)(c) of Bihar Prohibition and Excise Act.
3. As per F.I.R., on 06.02.2020 at 8:00 PM, during patrolling, the informant received an information that 4-5 persons had entered into a Girls Hostel and as such, he along with other police personnel reached there and after chase, caught one person in drunken state namely Rishikesh Kumar @ Sonu Mishra, who disclosed the name of petitioner and others, who fled away from there.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.44053 of 2026(2) dt.22-07-2026 2/2 petitioner is innocent and has been falsely implicated in this case only on the basis of confessional statement of apprehended co-accused Rishikesh Kumar @ Sonu Mishra. There is no allegation against this petitioner that he misbehaved with any girl of the hostel. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. II, Sitamarhi in connection with Nanpur P.S. Case No. 45 of 2020, subject to condition as laid down under Section 438(2) of the Cr.P.C. / Section 482(2) of the B.N.S.S.
