JUSTICE BIRENDRA KUMAR ORAL ORDER 17-01-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners are in custody in connection with K. Nagar P.S. Case No. 407 of 2017, a case under Section 302/34 of the Indian Penal Code.

Allegation against the petitioners is that for trivial dispute, they assaulted the deceased with slaps and fists as a result thereof, she died during the course of treatment. Considering the nature of allegation, for the purpose of this bail application at best a case of culpable homicide is made out, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the

Nagar Police Station Case No. 407 of 2017 with condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
