In this case, the petitioner has sought a relief that the Licensing Authority should restore the P.D.S. licence of the petitioner claiming that the dealership was cancelled on the ground that he was made an accused in Amnour P.S. Case No. 31 of 2009 for offence under Sections 302 & 34 of the Indian Penal Code. Now when the trial case has already been concluded and the petitioner has been acquitted, whereafter, he has filed an application before the Collector cum District Magistrate, Saran, Chapra, brining to his notice that he was made an accused, on that
Patna High Court CWJC No.16947 of 2015 dt.13-04-2017 account, the licence was cancelled, now he has been acquitted and, so, he should be brought back to the original position and his licence be restored but, till date, no order has been passed by the Collector. Let the petitioner file a representation before the SubDivisional Officer, Marhourah, Saran who, being the Licensing Authority, will consider the case of the petitioner and take decision in accordance with law.
With the aforementioned observation, this application is disposed of.
