JUSTICE SUDHIR SINGH ORAL ORDER 05-12-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner is apprehending his arrest in connection with Mahua P.S. Case No. 189 of 1991, T.R. No. 1578 of 2015 for the offence instituted under Section 392 of the Indian Penal Code.
The allegation against the accused persons is of committing loot of the motorcycle of the informant on the point of revolver.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. He has falsely been implicated in the present case. The petitioner is not
Patna High Court Cr.Misc. No.51239 of 2016 (2) dt.05-12-2016 2/2 named in the F.I.R. His name has come on the confessional statement of co-accused. There is no substantive evidence to suggest his implication in the present case. The other co-accused have been granted bail by the court below.
On behalf of the State, it has been submitted that the case is of the year 1991 and the petitioner has come to the court in the year 2016. There is no explanation for delay on the part of the petitioner.
Considering the aforesaid facts and circumstances, I am not inclined to extend the privilege of anticipatory bail to the petitioner. Prayer for anticipatory bail of petitioner is rejected in connection with Mahua P.S. Case No. 189 of 1991, T.R. No. 1578 of 2015, pending in the court of learned A.C.J.M.-V, Vaishali at Hajipur.
Anyhow if the petitioner surrenders in the court below within a period of six weeks from today, the same shall be considered on its own merit without being prejudiced by this order taking into account that the other co-accused have been granted bail.
