Petitioner seeks regular bail in connection with Mahila PS Case No. 32/2020 registered for the offence punishable under Sections 341, 376, 511, 323 of the IPC. Petitioner attempted to commit rape upon the informant who happens to be his sister-in-law (Bhabhi). Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case due to property dispute between the husband of the informant and the petitioner. He further submits that petitioner is in custody since 26.10.2020, the charge-sheet has been submitted in the matter

Patna High Court CR. MISC. No.52243 of 2021(2) dt.06-05-2022 2/2 and there is no likelihood that the petitioner will abscond or will tamper with the evidences.

Regards being had to the submissions made by the parties and taking into consideration the fact that petitioner is in custody since 26.10.2020, the charge-sheet has been submitted in the matter and there is no likelihood that the petitioner will abscond or will tamper with the evidences, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, CHHOTELAL YADAV @ CHHOTELAL KUMAR YADAV be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Saharsa in connection with Mahila PS Case No. 32/2020.
