The petitioner apprehends his arrest in connection with Sono P.S. Case No. 39 of 2009 for the offences punishable under sections 302, 120-B/201 of the Indian Penal Code. It has been submitted on behalf of the petitioner that the petitioner is not named in the first information report and even during the course of investigation his name has not come. After six months of the occurrence, the Deputy Superintendent of Police in his supervision note has mentioned the name of the accused persons including the petitioner making apprehension that they might have hands in the case and thereafter some witnesses have stated that in this occurrence hands of the relative of one Meena

Patna High Court Cr.Misc. No.48690 of 2016 (3) dt.19-01-2017 2/2 Devi may be there. Except that there is nothing against the petitioner.

Heard learned A.P.P. also who has opposed the prayer for anticipatory bail but he could not controvert the said facts. Having heard both sides and in view of the facts stated above, the petitioner, in the event of arrest or surrender in the court below within a period of four weeks from today, shall be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Jamui in connection with Sono P.S. Case No. 39 of 2009 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure, 1973 with further condition that if any incriminating article appears in the case showing hands of the petitioner, the prosecution shall be free to move for cancellation of bail of the petitioner and that the petitioner will cooperate in the investigation of the case and shall make himself available before the police as and when required.
