JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-01-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 384,385 and 387 of the Indian Penal Code.

As per the prosecution case, informant, who is Munsi of a construction company, received a ransom call of Rs.2 lacs on his mobile phone and next day five unknown accused persons, on the point of arms took Rs.50,000/- cash and cheque of Rs.1 lac from him and demanded more money from the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. FIR is against unknown. Petitioner's name has figured during course of investigation in confessional statement of coaccused Rahul Kumar. The only allegation against the petitioner is that his mobile phone was found active near the place of occurrence at the relevant time. Learned counsel for the petitioner further submits that the petitioner is accused in one more criminal cases but he is on bail in that case. Petitioner is in

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st class, Gaya in Alipur Police Station Case No. 75 of 2020.
