The petitioner seeks bail in connection with Dhanaha P.S. Case No. 71 of 2017 dated 12.04.2017 instituted for the offence under Section 30(A) of the Bihar Prohibition and Excise Act, 2016.
The petitioner was not arrested on the spot. On secret information, a raid was conducted and it was found that two persons left their motorcycles in the field and fled away. Later, the villagers found that the motorcycles belonged to the petitioner and one Birendra Yadav respectively. A total of 272 bottles of Indian Made Foreign Liquor was recovered from the two motorcycles. The total measurement of the liquor was 74 litres. The petitioner has clean antecedents and is in custody since 03.07.2017.
Patna High Court Cr.Misc. No.49487 of 2017 (4) dt.29-11-2017 Regard being had to the aforesaid facts, this Court is inclined to grant bail to him.
The petitioner above named is directed to be released on bail on his furnishing bail bond in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Bettiah (West Champaran) in connection with Dhanaha P.S. Case No. 71 of 2017.
