Petitioners seek bail in Mirganj P.S. Case No.160 of 2018 instituted for the offence under Section(s) 302 and other allied sections of Indian Penal Code.

Counsel for the petitioners submits that from First Information Report itself it is apparent that there is land dispute between the parties.

In the written report, it is alleged that petitioners along with other accused assaulted the informant with fists and slaps. The informant subsequently died during course of treatment.

Case diary has been received, wherein, postmortem report is available. The doctor has not found any external injury

Counsel for the petitioners submits that deceased was patient of hypertension and he died on account of that. Petitioners are in custody since 10.06.2018 and 09.06.2018 respectively having clean antecedents. In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, XVI, Gopalganj, in connection with Mirganj P.S. Case No.160 of 2018, subject to the condition that both the bailors shall be close relative of the petitioners. (Sanjay Priya, J) JA/- U T
