The petitioner seeks bail in anticipation of his arrest in connection with Nawada (Town) P.S. Case No. 351 of 2021, instituted for the offences under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that petitioner is neither tenant nor is concerned with the house from where liquor has been recovered, he is only residing nearby in the said house in a separate accommodation. Learned counsel submits that Section 30(a) of the Excise Act would, therefore, not lie as against the petitioner. I have considered the submission.
