The petitioner seeks bail in connection with Excise Case No. 133 of 2017 registered under Section 30(a), 30(d) of Bihar Excise Prohibition Act-2016.

10 lts. of country made liquor and 270 Kg. raw materials are said to have been recovered from the house of the petitioner in absence of any inmate of the house. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. The petitioner at the time of occurrence had gone to Gorakhpur along with his family members

Patna High Court Cr.Misc. No.2822 of 2018 (2) dt.24-01-2018 2/2 and the said house is inhibited by joint family of the petitioner. Petitioner has no concern with the seized article. The police has falsely implicated the petitioner in the case in order to save the real culprit at the instance of his enemies. Though, two criminal cases have been lodged against the petitioner but the petitioner has been enlarged on bail in the said cases. The petitioner has been languishing in custody since 24.11.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Bettiah, West Champaran in connection with Excise Case No. 133 of 2017.
