Earlier the prayer for bail of the appellant was rejected by this Court, vide order dated 19.8.2017 passed in Cr. Appeal (S.J.) No.1782 of 2017 Submission of the learned counsel for the appellant is that up till now only two witnesses have been examined in this case and the other co-accused person who succeeded in fleeing away from the place of occurrence has been granted bail by a coordinate Bench of this Court vide order dated 11.1.2018 passed in cr. Appeal (SJ) No.3043 of 2017 and the another co-accused has been granted bail vide order date 21.7.2017 passed in Cr. Appeal (SJ) No.1760 of 2017 and the petitioner is in custody for more than one year.

Patna High Court CR. APP (SJ) No.3562 of 2018 (4) dt.31-10-2018 2/2 Heard learned Special P.P. who has opposed the prayer for bail on the ground that the appellant was arrested just after the occurrence from the nearby place of the occurrence. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the appellant , however, the learned trial court is directed to expedite the trial and if possible to conduct it on regular basis so that the trial may be concluded within a period of nine months, With the aforesaid observation, this application is dismissed.
