JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 25-01-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Guraru P. S. Case No. 69 of 2015 registered under Sections 147, 148, 149, 307, 324, 325, 337, 342, 354, 379, 427 and 452 of the Indian Penal Code, Section 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 and Section 27 of the Arms Act.

It is alleged that as per allegation made in the FIR, 61 persons abused the informant by calling his caste name and assaulted him and his son Sashi Kant Kumar @ Guddu Kumar. It has been contended that there is specific allegation

No.54881 of 2015 (2) dt.25-01-2016 2/3 against co-accused Karu Singh of having assaulted the informant but the injuries sustained by him is simple one and it cannot be said that as to who had called him by caste name. It has further been contended that there is case and counter case and both sides have sustained injuries.

A web copy of order dated 17.12.2015 passed in Cr. Misc. No. 50133 of 2015 and Cr. Misc. No. 50647 of 2015 has also been produced in course of arguments. A perusal of the same would make it evident that co-accused Pankaj Singh, Samsher Singh, Ranjeet Singh, Vansh Singh, Durgesh Singh, Neeraj Singh, Rupesh Singh @ Karu Singh and Ammet Singh have already been granted privilege of anticipatory bail by a coordinate Bench of this Court. Let the web copy of order dated 17.12.2015 produced by the learned counsel for the petitioner be kept on record. Regard being had to the facts and circumstances of the case, in the event of arrest or surrender before the court below within six weeks from today, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Gaya in Guraru P.
