JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-10-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks regular bail in connection with Mairwa P. S. Case No. 231 of 2017 registered for offences punishable under Sections 272, 273, 308 and 420/34 of the Indian Penal Code and Sections 30 (A), 41 (i) of Bihar Excise and Prohibition Amendment Act, 2016.

Allegation against the petitioner is of recovery of 400 liter 950 ml English wine and six liters country made was recovered.

Submission of the learned counsel for the petitioner is that he has been falsely implicated and the petitioner has been remanded in this case from two months.

Patna High Court Cr.Misc. No.49412 of 2017 (2) dt.13-10-2017 2/2 Heard learned A.P.P. also.

Having hear both sides and in view of the facts and circumstances, as stated above as well as criminal antecedent of the petitioner, I am not inclined to grant privilege of bail to the petitioner with a further direction to the lower court to expedite the trial and conclude the same within a period of four months from the receipt/ production of a copy of this order of this court, if not concluded, the petitioner shall be released on bail to the satisfaction of trial Court.

With the aforesaid observation, the instant petition is disposed of.
