Petitioner, already in custody, seeks bail in connection with Bettiah Mufffasil P. S. Case No. 328 of 2017, registered under Section 38 of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that there is no recovery from the possession of the petitioner and the truck driver and others were apprehended for carrying the illicit liquor and they have been granted bail by Co-ordinate Benches of this Court vide order dated 17.10.2017 passed in Cr. Misc. No. 50165 of 2017, vide order 15.11.2017 passed in Cr. Misc. No. 54099 of 2017 and vide order dated 09.11.2017 passed in Cr. Misc. No.
Patna High Court Cr.Misc. No.3293 of 2018 (2) dt.30-01-2018 2/2 50843 of 2017. It is also submitted that there is no material, except confessional statement of co-accused stating that the petitioner supplied liquor but the petitioner has no any criminal antecedent and he is in custody since 30.10.2017.
Having considered the said facts and circumstances, the petitioner, Rajendra Singh @ Rajendra, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise , Bettiah, West Champaran in connection with Bettiah Muffasil P.S.Case No. 328 of 2017.
