Present:- Member(Judicial) :Mr. Justice Jitendra Mohan Sharma Member(Legal Profession) : Mr. Manoj Kumar No.1, Advocate AWARD The dispute between the parties having been referred for determination to the Lok Adalat and the parties having compromised/ settled the case/matter, the following award is passed in terms of the settlement: The learned counsel for the appellants and learned counsel for the respondent no. 2 with Regional Manager, Oriental Insurance Company Limited is present.

After persuasion the respondent no. 2 is ready to pay further amount Rs. 1,50,000/- without interest to the appellants by way of enhanced compensation. It is submitted that amount of Rs. 1,59,500/- with interest has already been paid to the claimants/appellants. The leaned counsel for the appellants is agreed to settle the dispute accordingly, and he is satisfied with the amount of Rs. 1,50,000/- without interest by way of enhanced compensation.

Accordingly, the respondent no. 2 is directed to pay Rs. 1,50,000/- by way of enhanced compensation before the concerned Motor Vehicles Accident Claim Tribunal, within two months and after deposit of the said amount, the learned Tribunal shall pay that amount to the claimants after proper verification within 15 days.

In the result, this Miscellaneous Appeal is hereby, disposed of. The parties are informed that the court fee, if any, paid by any of them shall be refunded.
