ANJANA MISHRA ORAL ORDER 18-10-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody since 03.06.2017 in connection with a case registered for the offences punishable under Sections 395 of the Indian Penal Code in which Section 412 of the Indian Penal Code was also added.

Learned counsel for the petitioner submits that the entire case against him is false and fabricated and he was not arrested along with the tractor. On the contrary, the tractor was found abandoned on national highway and though he has been in custody since long, he has not be placed on T.I.P. nor has been identified.

Considering the aforementioned facts and

Patna High Court Cr.Misc. No.48782 of 2017 (2) dt.18-10-2017 2/2 circumstances and that the petitioner has no criminal antecedent, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar, in connection with Korha P.S. Case No. 157/2017.
