The petitioner apprehends her arrest in Kishanganj Mahila P.S. Case No. 29 of 2016, registered for the offences punishable under Section 372 and other Sections of the Indian Penal Code and 3, 4 and 5 of Immoral Traffic Act. The informant alleged that the petitioner and her husband kept her for domestic work but later on the petitioner and her husband forced her for prostitution. When the informant refused, the petitioner assaulted her.

Learned counsel for the petitioner submits that the informant filed a petition before the learned court below that no such occurrence has been taken place. The doctor assessed the age of the victim between 19 to 21 years.

No.46762 of 2016 (2) dt.07-12-2016 2/2 It appears that the victim herself alleged that she was 18 years but the victim made specific allegation against the petitioner that she forced her for prostitution. Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.

If the petitioner, so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and prays for regular bail and his prayer shall be considered on its own merit without being prejudiced by this order.
