JUSTICE BIBEK CHAUDHURI ORAL ORDER 31-07-2025 The instant revision challenges an order dated 14.05.2025 passed by the learned Special Judge, Children's Court, Rohtas at Sasaram in Criminal Appeal No.06 of 2025, arising out of Suryapura P.S. Case No.247 of 2023, JJB Case No.233 of 2024, refusing prayer for bail of the petitioner, who is decided to be a juvenile on the date of commission of offence under Sections 302, 120B/34 of I.P.C. and Section 27 of the Arms Act.

2. It appears from the statement of the informant that the CICL was not named and one of the principle accused, who was apprehended by public after commission of offence or any other person apprehended on the ground of complicity. The adult accused persons were released on bail by this Court on

The petitioner was booked in the instant case on the statement of a third person recorded by police, who happens to be the unknown source of the Investigating Officer. No incriminating material was recovered from him. He is in custody since 02.12.2024.

3. Considering all such aspect of the matter and in view of the fact that the petitioner is on juvenile on the date of commission of offence, I am inclined to release the petitioner/CICL on bail.

4. Accordingly, the petitioner/CICL, above-named, may be granted bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, one of whom must be a local surety, to the satisfaction of the learned Juvenile Justice Board, Rohtas at Sasaram in connection with Criminal Appeal No.06 of 2025, arising out of Suryapura P.S. Case No.247 of 2023, JJB Case No.233 of 2024 with subject to following condition that:- (I) One of the bailor must be the mother of petitioner.

(II) further condition that if on bail he shall be under the care and protection of his mother and under the supervision of the Probation Officer, who will submit quarterly report about the antecedent of petitioner before the Board and if any such report is

5. With the above order, the instant criminal revision is disposed of.
