The petitioner apprehends his arrest in connection with Madhubani Town P.S. Case no. 334 of 2015, registered under Sections 147, 148, 149, 341, 323, 307 and 414 of the Indian Penal Code and Section 27 of Arms Act.
The accusation is that on receiving information about firing in between two groups, the informant along with other Police personnel reached at Shankar Chowk, where mob was present, who disclosed that due to supremacy in between two criminals groups two round firing was made in which one boy sustained bullet injury belonging to one group, who was rushed from place of occurrence boarding on motorcycle. The mob also disclosed that one group was leaded by Md. Dular and Arun Sah and they have fired in which
Patna High Court Cr.Misc. No.2425 of 2017 (2) dt.01-03-2017 2/2 Raman Ram received injury while other group leaded by Amit Mandal, Ajay Ram and Kesav Kumar along with 25 to 30 others. The informant reached at the house of Raman Ram, who disclosed about the occurrence and his injury was not grievous. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case mere on suspicion. Moreover, from the F.I.R. itself it appears that the injury which is said to be sustained by Raman Ram is simple in nature. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhubani in connection with Madhubani Town P.S. Case No.334 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
