1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Simri P.S. Case No. 153/ 2024 dated 06.05.2024 registered for the offence(s) punishable under Section(s) 457, 380 read with section 34 of the Indian Penal Code.

3. Mr. Santosh Kumar, learned counsel for the petitioner submits that the petitioner has been falsely dragged in this case on the basis of confessional statement of co-accused, Suraj Bhan Singh and no case under sections 457 and 380 of the IPC is made out against this petitioner. It is further submitted that against the petitioner, Simri P.S. case No. 27/2024 was lodged under sections 457, 380 read with section 34 of the I.P.C. in respect of the same stolen ornaments of the temple and in that

No.49033 of 2024(2) dt.21-08-2024 2/3 case the petitioner is on bail and he is jewelry shop owner and one co-accused who is alleged to have purchased some part of the stolen articles has been granted anticipatory bail by this Court vide order dated 19.08.2024 passed in Cr. Misc. No. 45650 of 2024 and the petitioner is facing two cases for the same occurrence.

4. Mr. Binod Kumar, learned APP appearing for the State has opposed the bail prayer of the petitioner.

5. Considering the facts and circumstances of this case as well as submissions noted above and mainly the fact that against the petitioner Simri P.S. case No.27/2024 was lodged in respect of the same stolen ornaments of the temple and in that case he is on bail and the present F.I.R. in which the petitioner is seeking anticipatory bail has been lodged for the same occurrence and the petitioner is said to be the jewelry shop owner and he is facing two cases in connection with the same occurrence and one co-accused who is alleged to have purchased some parts of the stolen articles has been granted anticipatory bail by this court, in my opinion, it is a fit case for grant of anticipatory bail to the petitioner. Accordingly, let the petitioner named-above, in the event of his arrest/surrender before the learned court below within a period of six weeks

Patna High Court CR. MISC. No.49033 of 2024(2) dt.21-08-2024 3/3 from today, be released on anticipatory bail in connection with Simri P.S.
