JUSTICE SHIVAJI PANDEY ORAL ORDER 16-09-2016 Heard learned counsel for the petitioner and learned counsel for the State.
In this case, primary grievance has been raised that the vacancies were published for 13 posts, but thereafter it was reduced to 03 posts. Claim has been made that the State-authority should not reduce the same i.e. from 13 to 03 posts which shows arbitrary act of the Commission.
From the counter affidavit it appears that 13 vacancies were published was a clerical mistake and it was modified to 03, actually only 03 posts were available for the appointment.
In such view of the matter, this Court does not find
Patna High Court CWJC No.11979 of 2013 (5) dt.16-09-2016 2/2 any error in the action of the respondent-authority. Accordingly, this petition is dismissed.
