====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 22-03-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with S.T. No.14 of 2020 arising out of Kochadhaman P.S. Case No.248 of 2019 registered for the offences punishable under Sections 302 and 201 of the Indian Penal Code.

The prosecution story in brief is that the informant Ugan Lal, Choukidar Kochadhaman Police Station gave a fardbeyan, which was recorded by S.I. Umesh Prasad, Kochadhaman Police Station on 10.09.2019 at 9.00 A.M. at near dead body of Mastan Chowk More side. It is further stating that on 10.09.2019 at about 8.15 in the morning when the informant lreturned from duty received information regarding one unknown death body of woman was found near Mastan Chowk in the paddy field. It is further alleged that some unknown

No.39957 of 2020(3) dt.22-03-2021 2/2 persons in conspiracy with each other murdered with the help of Saree tie on the neck of unknown woman and with a view to causing this appearance of evidence throw out the unknown woman in the field of Noor Islam near of Mastan Chowk. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. On the basis of confessional statement of the co-accused, the petitioner has been made accused in the present case. Petitioner is the husband of the deceased.

Considering the facts and circumstances that the petitioner is the husband of the deceased, I am not inclined to enlarged the above named petitioner on bail.

Accordingly, the prayer for bail of the above named petitioner in connection with S.T. No.14 of 2020 arising out of Kochadhaman P.S. Case No.238 of 2019 pending in the court of learned Additional District and Sessions Judge-III, Kishanganj is hereby rejected.
