====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMJAR MISHRA ORAL ORDER 14-12-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Kanti P.S. Case no. 62 of 2016, registered under Sections 420, 467, 468, 471 and 504 of the Indian Penal Code.

The accusation is that one Md. Sarfaraz Singh, who belongs to the mayka of the informant, came at the house of informant and informed that Md. Allauddin is selling 12 katha of land. Thereafter, in presence of villagers, informant gave Rs. 1,20,000/- to Md. Allauddin and her son Md. Wahid also sent Rs. 40,000/- in the account of Md. Allauddin and Rs. 40,000/- in the account of Salma Khatoon, wife of Md. Allauddin. Thereafter, she went to Registrar office for execution of the sale deed in her favour in respect to land of Md. Allauddin, but Md. Sarfaraz got executed the sale deed in respect

Learned counsel for the petitioner submits that petitioner is scriber of the deal and the beneficiary of sale deed, which is said to be got executed by co-accused Sarfaraj Alam in respect to land of the informant.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Muzaffarpur in connection with Kanti P.S. Case No.62 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
