The petitioner is in custody since 03.10.2017 in connection with Sessions Trial No. 855 of 2017 arising out of Dalsingh Sarai P.S. Case No. 315 of 2017 for the offence registered under Section 376/34 of the Indian Penal Code. Learned counsel for the petitioner submits that earlier prayer for bail of the petitioner was rejected vide order dated 04.05.2018 passed in Cr. Misc. No. 20357 of 2018. It is further submitted that the main accused, namely, Dharmendra Kumar @ Dharmendra Paswan, against whom there is specific allegation, has been granted bail by this Court vide order dated 18.04.2019 in Cr. Misc. No. 22634 of 2019. It is further submitted that the petitioner has merely been named in connection with the present
Patna High Court CR. MISC. No.40348 of 2019(2) dt.10-07-2019 2/2 case but there is no specific allegation against him. Considering the fact that the main accused has been granted bail in this case and that the petitioner has no criminal antecedent, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge, Dalsing Sarai, District Samastipur in connection with Sessions Trial No. 855 of 2017 arising out of Dalsing Sarai P.S. Case No. 315 of 2017.
