JUSTICE SATYAVRAT VERMA ORAL ORDER 15-02-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks regular bail in connection with Buxar (Town) P.S. Case No. 275 of 2021 instituted for the offences under Sections 25(1-b)a, 26 and 35 of the Arms Act. Learned counsel for the petitioner submits that the petitioner is in custody since 20.06.2021, charge-sheet has been submitted and has antecedent of one case.
Allegation is of recovery of a loaded country made pistol along with one live cartridge and Rs.80,000/- from the possession of the petitioner.
Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case and
Patna High Court CR. MISC. No.53594 of 2021(2) dt.15-02-2022 2/2 nothing was recovered from the possession of the petitioner. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.
Considering the fact that the petitioner is in custody and charge-sheet has been submitted, let the petitioner above named be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar (Town) P.S. Case No. 275 of 2021, with condition that one of the bailors shall be the brother of the petitioner, namely, Sharwan Kumar. (Satyavrat Verma, J) Kundan/- U T
