The petitioners apprehend their arrest in connection with Chanpatia P. S. Case No. 249 of 2017 registered for the offences punishable under Sections 420/511 of the Indian Penal Code.

Learned counsel for the petitioners submits that the name of these two petitioners are said to have been disclosed by co-accused Sonelal who was caught on chase and then was handed over to Police. Learned counsel submits that in course of investigation nothing has been recovered from possession of the petitioners and save and except the confessional statement of the co-accused there is no material against these petitioners.

Learned APP for the State submits that the name of the petitioners has been disclosed by co-accused. In the given facts and circumstances, considering the nature of allegations and that the name of these two petitioners have transpired in the confessional statement and nothing more has been brought before this Court and also the petitioners have no criminal antecedent, the petitioners above named, in case of their arrest or surrender within four weeks from today, are directed to be released on bail on execution of bail bonds of Rs. 15,000/- (fifteen thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, West Chamaparan at Bettiah in connection with Chanpatia P. S. Case No. 249 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
