JUSTICE ASHUTOSH KUMAR ORAL ORDER 22-06-2021 Heard Mr. Kumar Vishokanand, learned counsel for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Excise Case No. 618 of 2020 instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2020.

Though a very small quantity of liquor is said to have been recovered from behind the house of the petitioner but I am not inclined to grant anticipatory bail to him for the reason that he was earlier made accused in a case of similar nature, in which he has been granted bail.

The prayer for anticipatory bail is rejected.

No.39643 of 2020(3) dt.22-06-2021 2/2 However, if the petitioner surrenders before court below and seeks bail, the court below shall take into account that the recovery of small quantity is from an open space and shall pass orders in accordance with law, without being prejudiced by the fact that the present petition on his behalf has not been entertained.
