The petitioners seek regular bail in connection with Gwalpara P.S. No. 134 of 2017 instituted for the offences under Section 30(a) of the Bihar Prohibition Excise Act, 2016. The allegation is regarding recovery of illicit liquor from the motorcycle of the petitioners.

The learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case, they have a clean antecedent and are in custody since 01.10.2017. Considering the nature of accusation, the period of custody already undergone and the fact that they have got a clean

No.58988 of 2017 (2) dt.22-12-2017 2/2 antecedent, I direct the petitioners named above to be released on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, UdaKishunganj, Madhepura in connection with Gwalpara P.S. Case No. 134 of 2017.
