Petitioner seeks bail in Bihata P.S. Case No. 454/12 registered for the offence under Sections 341, 323, 326, 307, 504, 379/34, 302 of the I.P.C. and Section 27 of the Arms Act. Allegation as per the F.I.R. is of firing on the informant by the petitioner causing injury on his chest and later on he succumbed to his injury.
Submission on behalf of the learned counsel for the petitioner is that charge sheet has been submitted against the petitioner. Moreover, he has fired upon the deceased and as such he is in custody since 11.05.2018.
Heard the learned A.P.P. along with the informant who opposed the prayer for bail of the petitioner stating that though the
Patna High Court Cr.Misc. No.58745 of 2018 (3) dt.02-11-2018 2/2 petitioner is the named main accused in this case he did not choose to surrender in the court and that also shows the conduct of the petitioner.
Having heard both sides and in view of the facts and circumstances of the case, stated above, I am not inclined to grant bail to the petitioner. The prayer for bail of the petitioner is rejected.
The application is, accordingly, dismissed.
