The petitioner seeks regular bail in connection with Kaler P.S. Case No. 29 of 2017 instituted for the offences under Section 30(a) of the Bihar Excise & Prohibition Act, 2016. The allegation is regarding recovery of certain quantity of illicit liquor from a vehicle which was apprehended by the Police and the driver and the khalashi of the said vehicle disclosed that one Belwant Goyel of Haryana and the petitioner had to hand over the said liquor to one Santosh Kumar who is a resident of Muzaffarpur and the petitioner had told that they would be supervising the carrying of the said illicit liquor on way to its destination.

No.988 of 2018 (2) dt.18-01-2018 2/2 The learned counsel for the petitioner submits that merely on suspicion the petitioner has been roped in the present case, however, he is neither the owner of the vehicle nor he has been apprehended from the spot nor anything has been recovered from his conscious possession and he has a clean antecedent. It is submitted that the petitioner is in custody since 13.10.2017. Considering the nature of accusation, the period of custody already undergone and the fact that the petitioner is having a clean antecedent, I deem it fit and proper to enlarge the petitioner above named on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-2, Jehanabad in connection with Excise Case No. 1115 of 2017 arising out of kaler P.S.
